DUI Breathalyzer Overturned
At the urging of Ted Vosk, the Bellevue District Court threw out a bundle of DUI cases based upon insufficient evidence regarding the use of the BAC simulator (breathalyzer). Ted presented expert testimony on the complicated subject of temperature measurement and the thermodynamic properties of liquids. He then successfully convinced the Court that the City could not prove that the temperature of the BAC simulator solution was within the prescribed range during the individual tests.
