Under the Insurance Fair Conduct Act (IFCA) passed in Washington, if you can successfully prove a bad faith insurance claim, you are entitled to damages three times the amount of the claim you submitted for as well as attorney's fees. These treble damages only apply to claims made against your own insurance company if it can be proven that they violated the Washington Administrative Code (WAC) in how they handled your claim.
We can help establish the WAC was violated if your claim was denied or delayed on an unfair or improper basis. We will draft a letter stating this allegation, which under IFCA must be sent to your insurer and the insurance commissioner's office. The letter must notify them that you believe they have violated IFCA and that you are giving them 20 days to correct the problem. If your insurer does not fairly respond or provide an adequate timely 'fix', we can then move forward with the formal IFCA claim.
