My Spouse Tells Me I Don`t Need an Attorney for My Divorce

Often, one spouse might seek to convince their partner that there is no need to retain an attorney for their divorce. They might spin different arguments regarding the potential cost savings. The spouse may even prey upon the emotions of their partner claiming to be looking out for their best interests. These discussions are typically (though not always) a trap attempting to create a favorable resolution for one party only.

Here are 4 reasons why you should hire an attorney for your divorce:

Power Dynamics

In some relationships, one partner tends to hold substantial power over the other. This might be based on financial leverage, emotional leverage, and in some cases, even physical leverage. In these situations, the more controlling spouse will seek to maintain their power by refusing their partner the opportunity to seek guidance. This is a manipulative tactic that in most situations results in one spouse controlling negotiations and creating a favorable result for them alone.

Financial Discovery

Especially where one partner is a stay-at-home parent, financial issues are a major part of any divorce. In many cases, only one partner has access to and understands the marital finances. To control their spouse, one partner might advise the other to not retain counsel. The obvious goal of this situation is to prevent a full and open disclosure of financial assets and debts. Without a full disclosure, there is no way to know that the final settlement values are equitable. Hiring an attorney will help uncover the finances.

Emotional Toll

To ensure a better result, some more nefarious parties to divorce will play on the emotions of their spouse. Perhaps using guilt or involving children, if two separating parties are left to their own devices, often times emotions run high. Emotional responses to legal proceedings are usually bad news leading to worse results. Secondarily, the stress of dealing with your soon-to-be-ex creates a major emotional toll that is difficult to forget.

Better Results

This should go without saying. Attorneys know the law. Divorce can be complicated, so understanding the nuances regarding division of assets, parenting, and support is key to a successful result. If you are forced to go without counsel, it is likely you will omit important issues or lose out on assets for which you are entitled.
